While the details remain unknown, it is not classified as a 'hate crime' as yet although this death allegedly occurred during a personal argument. Farmitracker records this report for comparison: in relation to the harsh manner in which South African athlete Oscar Pistorius - also a murder-accused -- is dealt with by comparison. Pistorius, just like Van Niekerk, also needs to travel overseas to compete in professional athletic competions. However because of the massive news media attention to the Pistorius case, the athlete has been ordered into virtual imprisonment at the home of a relative and had to surrender his passport.

The circumstances surrounding the violent altercation between are completely unknown at this stage -- but Mr van Niekerk was arrested after a knife was discovered in his pocket. Mr Van Niekerk says he is innocent.

On 2 August 2013 Estella Naicker reported that Van Niekerk’s passport was returned to him at a second bail hearing that took place at the Newcastle Magistrate’s Court.
Initially, Mr van Niekerk was granted R15,000 bail on condition that he surrendered his passport. However, his attorney, Allen Kelly, successfully argued that Mr van Niekerk needed to work in order to afford his living expenses and legal fees. Mr van Niekerk, who is employed as a security consultant for a Non-Government Organisation (NGO) in South Sudan, had his passport returned to him. However, his bail was increased to R15,000 and his work schedule was handed to the court to ensure that he is in South Africa to attend future court proceedings.Mr Van Niekerk will make his next appearance at the Newcastle Magistrate’s Court on August 15.
