Illegal arrests of 2 Afrikaners: Juandré Rautenbach and Stephen Barnard of Nelspruit Concerned Citizens dumped in police holding cells while trying to subdue a drunken driver: Nelspruit: 31 January 2015 -- Two members of the Nelspruit Concerned Citizens (NCC) recently ended up in Nelspruit (the ANC-name is Mbombela) SAPS’ holding cells. According to Mr Juandre Rautenbach and Mr Stephen Barnard, they were unlawfully arrested by the police. Rautenbach says the incident occurred in Riverside on the morning of January 31. “We were informed of a VW Caddy being driven recklessly along the road between Kaapsehoop and Mbombela. The driver was apprehended at Emnotweni Casino.” At that point, Barnard was trying to subdue the driver of the Caddy by using his full body weight as the suspect was very aggressive. “I tried to calm him down, which resulted in death threats being aimed at me. He reeked of alcohol,” Rautenbach says. “After a while, Stephen released the suspect, who punched me in the ribs. He verbally threatened to kill me as well. I reacted by pushing him away from me. The SAPS arrived on the scene and the suspect told them that we launched a racially motivated assault on him, which we denied as it is untrue.” All parties were instructed to proceed to the police station. According to Rautenbach, the policeman, a constable Maseko, informed him, the driver of the Caddy, his passenger and Barnard that they were being charged. “I asked him what the charge was and he said that I was resisting arrest by asking that question. I asked whether I could contact my lawyer. ‘You are resisting arrest,’ he said. I kept quiet and followed the constable.” He then completed documents and instructed the suspects to sign them. “When I asked him what the documents were, he said that it is just a procedural step and that I must sign the papers. On further inspection I saw that these declarations acknowledged that the person who sign them has been read his rights. I was not willing to sign the document as this was not the case.” The policeman told them that the Afrikaner men ' had been resisting arrest" and unfortunately Barnard and Rautenbach signed these documents. Afterwards they learnt that they had been charged with assault with the intent to inflict grievous bodily harm. They were locked in a holding cell. Rautenbach was offered the chance to speak to his attorney, Mr Schalk de Waal. Barnard and Rautenbach were released on the same day and appeared in court on February 2. They will be back in court on February 24. The drunken driver was charged with reckless and negligent driving.
